These Terms and Conditions outline the rights and responsibilities between you (the client or user) and me (Hi This Is Bry), covering the use of this website and any services or products purchased.
By using this website or purchasing a service, you agree to these Terms and Conditions.
1. What I Do
Hi This Is Bry is a UK-based creative business offering branding, design, content creation, and visual strategy for small businesses, startups, and creatives.
2. Definitions
“Company”, “We”, “Me”, or “I” refers to Hi This Is Bry.
“You” refers to the person or business using the site or purchasing services.
“Service” refers to the website (https://hithisisbry.co.uk), all branding, design, content, digital products, and strategy work provided.
“Terms” refers to this agreement.
“Privacy Policy” refers to the related data policy located at https://hithisisbry.co.uk/privacy
3. Who Can Use This Site
You must be at least 18 years old to use this website or work with me. By using this site, you confirm that you meet this requirement.
You are responsible for complying with the laws and regulations in your country, including but not limited to GDPR, tax laws, and business obligations when using or implementing anything you purchase or download.
I reserve the right to refuse service, suspend work, or terminate access to products or services, including ending an active contract, if you breach these Terms or behave in an abusive, discriminatory, or otherwise inappropriate manner. In such cases, no refund will be provided for work already completed or resources already delivered.
4. Booking and Payments
All projects require an invoicing address (this may be a business or personal address depending on your setup). This is collected securely via my Formaloo intake form or requested via Gmail and is used for invoicing only.
All clients will receive a formal contract outlining the scope, timeline, deliverables, and payment terms. Work will only begin once the contract is signed and payment is received.
Signed contracts are stored securely in a password-protected cloud folder and are not shared with third parties.
All prices are listed in GBP (£). If you are purchasing from outside the UK, your bank or payment provider may apply additional fees or currency conversion charges, which are your responsibility.
Hi This Is Bry is not currently VAT registered. No VAT is charged on services or digital products.
If your payment is reversed, disputed, or fails after services or downloads have been delivered, you may lose access to work or files until payment is resolved. You remain liable for any outstanding amounts.
Payment Methods
Most packages are paid via Stripe Checkout. This allows you to pay using a debit or credit card. Some packages may also offer Klarna Pay in 3 as an option at checkout.
If you choose Klarna or another instalment provider, your payment agreement is with them. I do not control or have access to their credit decisions, policies, or repayment terms. I am not responsible for any issues that arise between you and Klarna.
For custom quotes or services not booked through Stripe Checkout, payment is made by bank transfer. These details will be included in your contract and invoice.
Payment must be received in full before any work begins, unless a different arrangement has been agreed in writing.
Due to the time and creative labour involved, services are non-refundable once work has commenced. If you wish to cancel before work begins, you may be eligible for a partial refund depending on the circumstances and time invested.
Fixed-Price Packages
The booking process includes:

Completing a Formaloo form (name, business name, email, address)

Payment via Stripe (full amount or in 3 with Klarna, Revolut, or debit/credit card)

A consultation is arranged

A contract is sent for signature

Work begins only after both contract and payment are received
VAT Note: Hi This Is Bry is not currently VAT registered. All prices are inclusive of any applicable taxes.
Klarna/Instalments Disclaimer: If you choose Klarna or another instalment provider, your payment agreement is with them. I am not responsible for their terms, policies, or payment issues.
Custom or Quoted Projects
If your package requires a custom quote:

You’ll complete the Formaloo form

A consultation is arranged

A contract is sent, including your agreed quote

Payment is made as outlined in the contract

Work begins only once the contract is signed and payment is received
If payment is not received within 5 business days of the contract being issued, the project may be cancelled and all agreed timelines and deadlines will become void.
If you continue to request work after a previous contract has ended, or you accept services following a quote or consultation, this may be treated as acceptance of the terms outlined here or in our prior agreement.
Small ad-hoc requests submitted via email (e.g. Gmail) or project management tools (e.g. Basecamp, Teamwork) may be accepted at my discretion. I retain full control over whether and how such requests are completed, and by proceeding with the work, you agree to be bound by these Terms and Conditions.
In such cases, I reserve the right to scope and bill these requests accordingly, even if no new contract is issued.
5. Revisions and Scope
Each project includes one round of reasonable amendments unless otherwise agreed in writing. Additional changes beyond the agreed scope will be quoted separately.
Revisions must be requested within 7 days of delivery unless otherwise agreed. If no feedback is provided within that time, the project may be marked as complete.
6. Digital Products & Waiver of Cancellation Rights
By downloading, accessing or purchasing any digital product from Etsy and Gumroad (including templates, planners, guides, or other resources), you agree to these Terms and Conditions.
In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you acknowledge that your 14-day right to cancel does not apply once download or access begins.
By proceeding to download, you confirm you waive your right to cancel under the Consumer Contracts Regulations.
Digital products are non-refundable once downloaded or accessed.
If your payment is reversed, disputed, or fails after services or downloads have been delivered, you may lose access to work or files until payment is resolved. You remain liable for any outstanding amounts.
All digital products are licensed for personal or internal business use only. You may not copy, modify, redistribute, resell, or claim ownership of any downloaded content. All content remains the intellectual property of Hi This Is Bry.
If your payment is reversed, disputed, or fails after services or downloads have been delivered, you may lose access to work or files until payment is resolved. You remain liable for any outstanding amounts.
7. Ownership, Copyright & Licensing
All original work created by me (e.g. branding, illustrations, layouts, or written content) remains my intellectual property unless explicitly transferred in writing.
Clients are granted a commercial licence to use final deliverables for their own business. This includes end-use rights but does not include source files or editable assets unless agreed.
This licence does not grant automatic copyright ownership. If you wish to purchase full copyright ownership, this must be requested in writing. A separate fee and written agreement may be required.
You may not resell or redistribute any fonts, assets, or files included in the final deliverables.
Final designs and digital products are licensed for use by the original purchaser only and may not be transferred, sublicensed, or used by third parties without written permission.
You agree not to misuse the website, services, or content. This includes scraping, copying, redistributing, or falsely claiming authorship of any work. Misuse of content or communication tools may result in service refusal or legal action.
Fonts
I use commercially licensed fonts, typically from Google Fonts or other open-source libraries.
If you request a premium or non-standard font, you are responsible for obtaining the correct licence. You must provide proof of licensing if the font is intended for trademark or commercial logo use.
I am not responsible for misuse of unlicensed fonts provided or requested by the client.
Images
I use royalty-free stock images (e.g. from Unsplash or Pexels) that are free for commercial use. These are non-exclusive and may be used by others online. You are encouraged to replace stock photos with your own original photography over time. (Photography service not offered).
Envato Elements (Premium Assets)
I hold a valid Envato Elements subscription. Assets from Envato (e.g. icons, textures) can be used in final client work upon request but:

Cannot be reused, extracted, or resold separately

Remain under Envato’s licence

Are only valid for that specific design
If you want exclusive ownership, I recommend requesting custom graphics or purchasing individual licensing. I offer this as an additional service.
8. Wix Website Ownership & Responsibility
Platform Ownership
Wix is a third-party website builder. You (the client) must maintain your own Wix account and subscription. Wix retains ownership of the platform, templates, and system components. These are licensed to you under Wix’s terms and cannot be transferred by me.
Intellectual Property (IP) & Licensing
I retain IP rights for all original design work created in the Wix project (e.g. layout styling, icons, illustrations). Upon full payment, I grant you a licence to use these for your business website.
This licence does not include:

The Wix template

Prebuilt Wix features or third-party elements

Fonts, images, or integrations not created by me
You are responsible for complying with all third-party licences you use or add to your website.
3. GDPR & Legal Compliance
Once your site is handed over, you are responsible for:

Being the legal data controller

Providing your own Privacy and Cookies Policies

Ensuring your contact forms, newsletter signups, and integrations are GDPR compliant

Managing and securing any data collected via your site
I am not liable for legal compliance after handover. You are advised to seek legal advice if unsure.
4. Maintenance & Ongoing Support
Once the website is transferred:

You are responsible for maintaining it

I do not provide ongoing updates unless separately agreed

You should regularly log in to Wix to manage performance, billing, or security issues
9. Canva-Based Designs
If your design includes Canva-based content:

You may use the final designs for your business (e.g. social media, print, or web)

You do not own the Canva template, fonts, or stock elements used
-
These are licensed via Canva and must be used in accordance with their terms
Editable links may be provided, but:

You must save them to your own Canva account

You are responsible for having Canva Pro if required

I retain control over templates stored in my account

Editable files may be removed 30 days after final delivery unless otherwise agreed.
I do not provide ongoing editing or support unless included as part of your package.
10. Limitation of Liability
To the fullest extent permitted by law, Hi This Is Bry accepts no liability for any loss, damage, or harm resulting from the use or misuse of services, strategy, or digital products, whether direct or indirect.
This includes but is not limited to: lost profits, missed opportunities, data loss, or reputational harm.
All work is provided in good faith based on the best information available at the time of delivery.
No guarantees are made regarding the results of any creative, strategic, or template-based work.
No part of the service guarantees business results, sales increases, or legal compliance. You are responsible for ensuring you comply with any laws relevant to your location and business.
All strategy, content, or downloadable resources are for general information purposes only and do not constitute professional, legal, financial, or medical advice. Please seek qualified advice for your specific situation.
11. External Tools & Third-Party Mentions
If a service or tool (e.g. Canva, Wix, MailerLite) is mentioned or used, this does not imply endorsement or affiliation. I am not responsible for the behaviour, uptime, or terms of any third-party platform.
I am not responsible for any issues related to platform access, downtime, or listing removal by Gumroad, Etsy, or Stripe. If a product becomes unavailable, please contact me for support.
12. Availability & Force Majeure
I do my best to provide stable services and timely communication. However, I cannot guarantee 100% availability.
In the event of illness, emergency, power failure, or internet issues, I will notify you as soon as possible.
If I am unable to complete the work, a partial refund may be offered based on the uncompleted scope.
I am not responsible for missed deadlines or service disruption caused by force majeure events such as natural disasters, technical failures, or government intervention.
13. Governing Law
These Terms are governed by the laws of England and Wales.
Any disputes will be handled under UK jurisdiction.
