Terms and Conditions

These Terms and Conditions outline the rights and responsibilities between you (the client or user) and me (Hi This Is Bry). They cover the use of this website and any services or products purchased.

By using this website or purchasing a service, you agree to these Terms and Conditions.

1. What I do

Hi This Is Bry is a UK-based creative business offering branding, design, content creation and visual strategy for small businesses, startups and creatives.

Hi This Is Bry builds marketing brochure websites, provides branding and design services, and offers social media strategy and content support. The scope of each project is agreed before work begins.

The following services are not offered under any circumstances:

  • Ongoing SEO strategy (light SEO foundations are included in website builds as standard)

  • Paid social media advertising or ad management

  • Social media account setup or creation

  • Access to or management of client social media accounts

  • Payment portal setup (such as Stripe) or financial advice

  • Domain registration, DNS configuration or email setup

  • Legal page copywriting or compliance advice
     

Where relevant, Hi This Is Bry can refer clients to trusted specialists in their network.
 

2. Definitions
"Company", "We", "Me", "Designer" or "I" refers to Hi This Is Bry.
 

"You" or "Client" refers to the person or business using the site or purchasing services.
 

"Service" refers to the website (https://hithisisbry.com) and all branding, design, content, digital products and strategy work provided.
 

"Terms" refers to this agreement.
 

"Privacy Policy" refers to the related data policy located at https://hithisisbry.com/privacy
 

3. Who can use this site

You must be at least 18 years old to use this website or work with me. By using this site, you confirm that you meet this requirement.

 

You are responsible for complying with the laws and regulations in your country, including GDPR, tax and business obligations when using or implementing anything you purchase or download.
 

I reserve the right to refuse service, suspend work or terminate access to products or services if you breach these Terms or behave in an abusive, discriminatory or otherwise inappropriate manner. In such cases, no refund will be provided for work already completed or resources already delivered.

4. Booking and payments

Before work begins, the client must complete the client acceptance form, providing their name, company name, email address and a digital signature confirming acceptance of these Terms and Conditions. On submission, the client will be sent an invoice digitally. Work begins only once the acceptance form has been submitted and payment has been received in full.

Form submissions are recorded automatically via Wix and sent to a secure, password-protected Gmail account held by Hi This Is Bry. Records may also be stored on a password-protected cloud device as an additional backup.

All prices are listed in GBP (£). If you are purchasing from outside the UK, your bank or payment provider may apply additional fees or conversion charges.

Hi This Is Bry is not VAT registered. No VAT is charged on any services or digital products.

If your payment is reversed, disputed or fails after services or downloads have been delivered, you may lose access to work or files until payment is resolved. You remain liable for any outstanding amounts.

5. Payment methods

Payments are made by bank transfer. For clients outside the UK, payments are accepted via Wise. These details are included in your invoice.

For larger projects, payment is split into two instalments: 50% is due before work begins and 50% is due upon completion. For smaller projects, full payment upfront may be required.

Payment must be received before work begins unless a different arrangement has been explicitly agreed in writing.

All services are non-refundable once work has commenced. No refunds will be issued except where required by law. Where a refund is due under law, Hi This Is Bry reserves the right to offer an equivalent value in services or goods in the first instance.
 

6. Final invoice as project acceptance

Payment of the final invoice will be treated as full acceptance of the completed project and all deliverables. By making the final payment, the client confirms that the project has been delivered to the agreed scope and that no further work is owed under the original agreement.
 

7. Right to refuse service

Hi This Is Bry reserves the right to refuse service or decline any request at any time, including requests made after a project has been completed and invoiced. Any work, amendments or additional requests outside of the agreed project scope must be formally quoted and invoiced before work begins. Unpaid or unquoted requests will not be actioned under any circumstances.

8. Timelines

A project timeline will be agreed between the Designer and the client prior to work commencing, based on the specific requirements of the project. Hi This Is Bry will always endeavour to meet agreed deadlines.

However, timelines may be affected by circumstances beyond reasonable control, including but not limited to illness, family emergency, bereavement or other exceptional circumstances. In such cases, the client will be notified as soon as reasonably possible and a revised timeline agreed.

The client also accepts that delays caused by late feedback, late payment or failure to provide required materials may affect the agreed timeline. Hi This Is Bry is not liable for project delays resulting from the client's failure to respond or provide necessary information in a timely manner.

9. Revisions and scope

Each project includes two rounds of reasonable amendments unless otherwise agreed in writing.

Once the second round of amendments is complete, the project will be automatically considered signed off.

Additional changes beyond the agreed scope will be quoted separately before any work is carried out.

Revisions must be requested within 7 days of delivery unless otherwise agreed. If no feedback is received within that time, the project may be marked as complete.

For website clients, the client agrees not to make any changes to the website themselves until both rounds of amendments have been completed and signed off. This is to prevent ongoing loops of changes and ensure the project can be completed cleanly within the agreed scope.

11. Communications

All project communications, requests, approvals and agreements must be made in writing via email or the agreed project management tool. This provides a clear record for both parties and ensures nothing is missed or misunderstood.

Onboarding calls and scheduled check-in calls are an exception to this, as these are part of the agreed service. However, any requests, decisions or details discussed or agreed during a call must be followed up in writing via email by the client before they can be considered confirmed. Hi This Is Bry is not responsible for acting on anything discussed verbally that has not been confirmed in writing.

12. Abandoned projects

If a project becomes inactive due to a lack of response or engagement from the client for a period of 60 days or more, it will be considered on hold. Any payments already made will be retained. Hi This Is Bry will endeavour to deliver the service if the client returns, subject to availability at that time. Hi This Is Bry reserves the right to review pricing upon resumption if costs or circumstances have changed since the original agreement.

13. Confidentiality

Both parties agree to keep any sensitive business information shared during the course of a project confidential and not to disclose it to any third party without prior written consent. This does not apply to information that is already publicly available or that is required to be disclosed by law.

14. Non-disparagement

Both parties agree not to make false, misleading or publicly damaging statements about the other, including on social media, review platforms or in any other public forum. Hi This Is Bry reserves the right to respond to factually inaccurate public statements in order to protect its reputation.

15. Dispute resolution

In the event of a dispute arising from these Terms or any project undertaken by Hi This Is Bry, both parties agree to attempt to resolve the matter between themselves in good faith before pursuing any formal legal action. Either party may raise a dispute in writing via email. Both parties agree to allow a period of 30 days from the date the dispute is raised to attempt resolution before escalating further.

16. Clarity Services

Hi This Is Bry offers Clarity Services for websites, branding and social media. These are one-off audit and advisory services that provide an honest assessment of the client's current position and a set of recommendations for next steps.

All advice given as part of a Clarity Service is provided in good faith and based on current best practice and professional experience. Hi This Is Bry is not liable for any outcomes, results or decisions made by the client as a result of the recommendations provided. The recommendations are a starting point and their effectiveness will depend on how and whether the client chooses to act on them.

Each Clarity Service document is produced uniquely for the individual client and their specific situation. It may not be shared, distributed, resold, published or passed on to any third party in whole or in part without the prior written consent of Hi This Is Bry.

No follow-up support is included as standard after delivery of the Clarity Service document. Any additional support required after delivery will be quoted and invoiced separately.

17. Digital products and cancellation rights

By downloading, accessing or purchasing any digital product from Etsy or Gumroad (including templates, planners, guides or other resources), you agree to these Terms.

In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you acknowledge that your 14-day right to cancel does not apply once download or access begins. By proceeding to download, you confirm you waive your right to cancel.

Digital products are non-refundable once downloaded or accessed. No refunds will be issued except where required by law. Where a refund is due under law, Hi This Is Bry reserves the right to offer an equivalent value in services or goods in the first instance.

If your payment is reversed, disputed or fails after delivery, you may lose access until payment is resolved. You remain liable for any outstanding amounts.

All digital products are licensed for personal or internal business use only. You may not copy, modify, redistribute, resell or claim ownership. All content remains the intellectual property of Hi This Is Bry.

18. Coaching sessions

Coaching sessions are non-refundable once payment is received. By paying, you agree the service begins immediately and waive your statutory 14-day cooling-off right under the Consumer Contracts Regulations.

If you cannot attend your booked time, you may request to reschedule with at least 48 hours notice, subject to my discretion.

Results are not guaranteed. Advice is provided in good faith. Sessions are for the named client only and are non-transferable. Recording, copying or sharing any part of the session (audio, video or written materials) without written consent is not permitted.

19. AI and creative tools

Hi This Is Bry uses a range of creative tools and software in the production of client work. AI-assisted features are present in many of these tools as standard, and Hi This Is Bry uses them responsibly and transparently where relevant.

All logos, illustrations and original artwork are created by hand. Where AI-assisted features are used within creative software, such as background expansion tools in Photoshop, these are used as minor technical aids rather than as a means of generating creative output.

In rare cases where a conceptual mockup is required to visualise a design (for example on a piece of packaging), an AI-generated mockup may be used if no suitable human-made alternative can be found. This will only ever happen with the client's explicit prior consent.

For stock photography, human-made images from reputable sources are used wherever possible.

20. Ownership, copyright and IP transfer

All original creative work produced by Hi This Is Bry remains the intellectual property of Hi This Is Bry unless explicitly transferred in writing.

Upon full and final payment, the client is granted a commercial licence to use all final deliverables for their business. Full intellectual property transfer is provided as standard upon project completion, confirmed via the IP document issued at handover.

 

Upon IP transfer, the client may use, reproduce and trademark the final deliverables without restriction for their business purposes.

Hi This Is Bry retains the right to display the final deliverables in their professional portfolio, including on their website, social media, printed portfolio and award submissions.

Hi This Is Bry retains the copyright in all unused drafts, concepts or preliminary designs not chosen as part of the final deliverables.

This handover does not include ownership of any fonts, stock images or other third-party licensed elements used within the design, as these remain subject to their original licences. It also does not include ownership of working files such as Adobe Illustrator or Photoshop source files, unless explicitly agreed otherwise in writing. Permission to modify the designs is not granted unless agreed in writing.

Hi This Is Bry provides all final deliverables in good faith and to the best of their professional ability. Hi This Is Bry is not liable for any indirect, incidental or consequential loss or damage arising from the client's use of the deliverables. The client accepts full responsibility for how the deliverables are applied in their business, including but not limited to trademark registration, marketing and commercial use.

Final files are delivered via WeTransfer. Once files have been downloaded, Hi This Is Bry will receive an automatic notification from WeTransfer confirming delivery. This notification is accepted as proof of delivery. From that point, the client assumes full responsibility for the storage, management and backup of all files.

21. Withholding of IP transfer

Hi This Is Bry reserves the right to withhold or withdraw IP transfer in the following circumstances:

Where the client has behaved in an abusive, threatening or inappropriate manner at any point during or after the project.

 

Where the client requests the removal of work from Hi This Is Bry's portfolio, social media or other promotional materials. Hi This Is Bry retains the right to display completed work as part of its portfolio unless a written confidentiality agreement has been agreed and signed prior to the project commencing.

In such cases, the client retains a licence to use the work for its intended purpose but full IP ownership will not be transferred. Hi This Is Bry retains all moral and intellectual property rights under UK copyright law.

22. Portfolio consent

By engaging Hi This Is Bry and accepting the completed deliverables, the client confirms that Hi This Is Bry may display the final work in their professional portfolio, including on their website, social media, printed materials and award submissions. This consent is given unless a written confidentiality agreement has been signed prior to the project commencing.

23. Fonts

Commercially licensed fonts are used, typically from Google Fonts or open-source libraries.

If you request a premium or custom font, you are responsible for obtaining the correct licence and providing proof of this if the font is to be used for trademark or logo purposes.

Hi This Is Bry is not responsible for misuse of unlicensed fonts supplied or requested by the client.

24. Images and assets

Royalty-free stock images from sources such as Unsplash and Pexels are used where required. These are free for commercial use but are non-exclusive and may appear in other projects. You are encouraged to replace stock images with your own photography over time.

25. Canva elements

Some projects may incorporate stock elements sourced from Canva, such as small illustrative details or decorative assets, where appropriate. All designs are created from scratch by Hi This Is Bry and are not built from Canva templates.

Editable Canva files are not provided as standard. Where a client specifically requests to purchase an editable Canva file, this may be offered at Hi This Is Bry's discretion and will be agreed separately in writing. Any Canva stock elements used within a design remain subject to Canva's licence terms and cannot be extracted, redistributed or used independently of the final design.

26. Wix websites, domains, DNS, email and client responsibilities

Hi This Is Bry builds marketing brochure websites using the Wix classic editor. These are professional, well-designed sites intended for small businesses and solopreneurs who want a clean, accessible online presence they can manage themselves after handover.

If the client books a website build service, they agree that their requirements are for a marketing brochure website and understand that more complex functionality may fall outside the scope of this service. If there is any uncertainty about whether a project is suitable, this will be discussed and confirmed before work begins.

Wix is a third-party platform. You, the client, must maintain your own Wix account, domain and subscription. Wix retains ownership of the platform, templates and system components. These cannot be transferred or managed by Hi This Is Bry.

Hi This Is Bry is not responsible for any issues that arise during or after the website build that are caused by the client's own actions, including but not limited to changes made to the site, domain or account settings by the client or any third party acting on their behalf.

Platform limitations

Wix is a third-party platform and, as with all website builders, certain styling and functionality may be subject to the limitations of the platform itself. Hi This Is Bry will always work to the best of their ability within the tools available, but it is not always possible to override platform-level restrictions.

 

Hi This Is Bry is not liable for any limitations, constraints or changes to functionality that are imposed by Wix as a platform, including but not limited to updates, feature changes or the removal of functionality by Wix. Any known limitations relevant to a specific project will be flagged before work begins where possible.

Domain registration, hosting, DNS configuration and email setup are not included within this service. The client accepts full responsibility for managing their domain provider account and all associated technical settings. Hi This Is Bry does not access, edit, configure, advise on or troubleshoot domains, DNS records, hosting accounts or email services under any circumstance.

The client understands that changes to domain configuration may affect website visibility and email services, including temporary disruption during DNS propagation. DNS propagation refers to the period during which updated domain records are distributed across global servers, which may result in temporary inaccessibility.

 

The client accepts full responsibility for researching, implementing and troubleshooting all domain and email configuration, either independently or by contacting their domain provider, Wix Support or their email provider directly.

Hi This Is Bry shall not be liable for any direct, indirect or consequential loss arising from domain registration, hosting, DNS configuration, email setup or any related technical changes undertaken by the client or their third party providers.

For technical support relating to domains, DNS, hosting or email, the client must contact Wix Support or MailerLite Support directly via their respective websites.

Hi This Is Bry retains IP rights for all original design work created within the Wix project, including layout styling, icons and illustrations. Upon full payment, the client receives a licence to use these assets for their business. This licence does not include prebuilt Wix features, third-party elements, fonts, images or integrations not created by Hi This Is Bry.

The client is responsible for compliance with all third-party licences used on their website.

Cookies banner

The client is responsible for adding and maintaining their own cookies consent banner on their Wix website after handover. This can be done via the Wix App Market.

The client is responsible for choosing an appropriate app. The client is also responsible for keeping their cookies banner up to date in line with any changes to their website or applicable regulations. Hi This Is Bry does not set up, configure or manage cookies banners on behalf of clients.

Website security

After handover, the security of the website is the responsibility of the client and Wix as the platform provider. Hi This Is Bry is not liable for any security issues, data breaches or vulnerabilities arising during or after the website has been transferred to the client.

Domain and website access

If the client does not have access to their existing domain or website because a previous developer controls them, the client must request that the domain is transferred into an account they have full access to. Before making any changes, the client should take screenshots of the existing site and save all content they wish to keep.

Once the domain is accessible, the client will need to set up a Wix account, purchase a subscription and connect their domain. Hi This Is Bry can then be added as a collaborator and the site can be rebuilt in Wix, with the client retaining full access throughout and after the project.

Legal pages

Hi This Is Bry can set up Privacy Policy and Terms pages within the website and add a basic cookies banner. However, the written legal content of these pages is the sole responsibility of the client. These are legal documents and the client is strongly advised to seek professional legal advice to ensure compliance with all applicable laws and regulations. Hi This Is Bry is not liable for the legal accuracy or completeness of any content provided by the client for these pages.

Payment portals

If the client wishes to integrate a payment portal such as Stripe into their website, this must be set up independently by the client. Hi This Is Bry does not set up payment systems, handle financial account information or advise on payment methods. Once the client has set up their payment portal and provided the relevant links, Hi This Is Bry can integrate these into the website design. The client is responsible for connecting and configuring all payment functionality within Wix.

27. MailerLite

MailerLite integration is limited to adding and styling signup forms within the Wix website. Hi This Is Bry does not manage MailerLite accounts, link or authenticate domains, configure sending domains or provide support for email setup, deliverability or account-related issues.

Before MailerLite integration can be carried out, the client must have set up a business email address matching their website domain, created and authenticated their MailerLite account, and connected and verified their domain within MailerLite. The client is responsible for arranging this setup independently, with the assistance of a technical specialist or IT professional if required.

The client acknowledges that domain or email changes may result in temporary loss of website or email access and confirms that they have planned accordingly to avoid disruption to their business operations.

Newsletter templating within MailerLite is available as a separate service and is not included as standard.

28. Social media services

Hi This Is Bry offers social media strategy, content planning and content creation support. The following terms apply to all social media related work.

The client must have existing, active social media accounts before any social media work can begin. Hi This Is Bry does not create or set up social media accounts on behalf of clients as this involves handling private personal information.

Hi This Is Bry does not access, log into or manage client social media accounts under any circumstances. Where scheduling assistance is agreed for select clients, this will be carried out exclusively through a third-party scheduling tool. The client is responsible for setting up, paying for and managing their own scheduling tool account. Hi This Is Bry will not have direct access to the client's social media platforms at any time.

Hi This Is Bry does not offer paid social media advertising or ad management. Creative support for advertising assets may be available as a custom request.

Results and expectations

Social media results can vary significantly depending on a number of factors outside of Hi This Is Bry's control. These include but are not limited to: whether the client actions the strategy and content provided, the consistency and activity level of the client's account, algorithm changes and platform updates, and wider market or seasonal factors.

No guarantees are made regarding follower growth, engagement rates, reach or any other metric. Hi This Is Bry provides strategy and content in good faith based on current best practice. A free growth guide is available to all social media clients to support their efforts between sessions.

29. GDPR and legal compliance

After handover, you are responsible for:

  • Acting as the legal data controller

  • Providing your own Privacy and Cookies Policies

  • Keeping your cookies banner installed, active and up to date

  • Ensuring forms, newsletters and integrations are GDPR-compliant

  • Managing and securing any collected data

  • Managing and storing files after the initial transfer to your provided email address
     

Hi This Is Bry is not liable for legal compliance during the build and after handover. Please seek professional advice if unsure.
 

30. Maintenance and support

Once the website is transferred, you are responsible for maintaining it. Ongoing updates are not provided unless separately agreed and invoiced.

You should log in regularly to manage performance, billing and security.

Website clients are offered an affordable ongoing update service if they would prefer not to make changes themselves. This is a separate arrangement and must be agreed in writing.

31. Limitation of liability

The Designer will provide services with reasonable skill and care but makes no guarantee of specific business results or outcomes.

To the fullest extent permitted by law, Hi This Is Bry accepts no liability for any loss, damage or harm resulting from use or misuse of services or products, whether direct or indirect.

This includes lost profits, missed opportunities, data loss or reputational harm. All work is delivered in good faith based on the best information available at the time. No guarantees are made regarding business results, sales or compliance.

All strategy, templates and resources are for general information only and do not constitute legal, financial or medical advice. You are responsible for ensuring your business follows all relevant laws.

32. External tools and third-party mentions

If a service or tool such as Canva, Wix or MailerLite is mentioned or used, this does not imply endorsement or affiliation. Hi This Is Bry is not responsible for the behaviour, uptime or policies of any third-party platform, nor for issues such as downtime, platform bans or product removal by Gumroad or Etsy.

33. Availability and force majeure

Hi This Is Bry aims to provide timely communication and reliable services but cannot guarantee 100% availability.
 

In the event of illness, emergency, power failure or internet disruption, the client will be notified as soon as possible. If work cannot be completed, a partial refund may be offered based on the uncompleted scope, at my discretion.
 

Hi This Is Bry is not responsible for missed deadlines or service disruption caused by force majeure events such as natural disasters, technical failures or government action.
 

34. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision will be limited or removed to the minimum extent necessary, and the remaining Terms will continue in full force and effect.
 

35. Governing law

These Terms are governed by the laws of England and Wales. Any disputes will be handled under UK jurisdiction.

36. Changes to these Terms

These Terms and Conditions may be updated from time to time. The most recent version will always be available on this website.
