These Terms and Conditions outline the rights and responsibilities between you (the client or user) and me (Hi This Is Bry). They cover the use of this website and any services or products purchased.
By using this website or purchasing a service, you agree to these Terms and Conditions.
1. What I do
Hi This Is Bry is a UK-based creative business offering branding, design, content creation and visual strategy for small businesses, startups and creatives.
2. Definitions
“Company”, “We”, “Me”, or “I” refers to Hi This Is Bry.
“You” refers to the person or business using the site or purchasing services.
“Service” refers to the website (https://hithisisbry.com) and all branding, design, content, digital products and strategy work provided.
“Terms” refers to this agreement.
“Privacy Policy” refers to the related data policy located at https://hithisisbry.com/privacy
3. Who can use this site
You must be at least 18 years old to use this website or work with me. By using this site, you confirm that you meet this requirement.
You are responsible for complying with the laws and regulations in your country, including GDPR, tax and business obligations when using or implementing anything you purchase or download.
I reserve the right to refuse service, suspend work or terminate access to products or services (including ending an active contract) if you breach these Terms or behave in an abusive, discriminatory or otherwise inappropriate manner. In such cases, no refund will be provided for work already completed or resources already delivered.
4. Booking and payments
All clients receive a formal contract outlining the scope, timeline, deliverables and payment terms. Work begins only once the contract is signed and payment is received.
Signed contracts are stored securely in a password-protected cloud folder and are not shared with third parties.
All prices are listed in GBP (£). If you are purchasing from outside the UK, your bank or payment provider may apply additional fees or conversion charges.
Hi This Is Bry is not currently VAT registered, and no VAT is charged on services or digital products.
If your payment is reversed, disputed or fails after services or downloads have been delivered, you may lose access to work or files until payment is resolved. You remain liable for any outstanding amounts.
5. Payment methods
Payments are made by bank transfer or Wise for payments outside the UK. These details are included in your invoice.
Payment must be received in full before any work begins unless a different arrangement has been agreed in writing.
Due to the time and creative labour involved, services are non-refundable once work has commenced. If you cancel before work begins, a partial refund may be offered depending on time invested.
6. Fixed-price packages
The booking process includes:

Hi This Is Bry is not VAT registered. All prices include any applicable taxes.
7. Custom or quoted projects
For quoted projects:

You contact me through my contact form or reach out via email

A consultation is arranged

A quote is sent in writing

A contract including the agreed quote is issued

Payment follows the contract terms

Work begins only once the contract is signed and payment received

If you continue to request work after a previous contract has ended, this may be treated as acceptance of the terms outlined here or in the prior agreement.
Small ad-hoc requests submitted via email or project tools (e.g. Basecamp, Teamwork) may be accepted at my discretion. I retain full control over whether and how such requests are completed. By proceeding, you agree to be bound by these Terms and Conditions.
I may scope and bill ad-hoc requests separately even if no new contract is issued.
8. Revisions and scope
Each project includes one round of reasonable amendments unless otherwise agreed in writing. Additional changes beyond the agreed scope will be quoted separately.
Revisions must be requested within 7 days of delivery unless otherwise agreed. If no feedback is provided within that time, the project may be marked as complete.
9. Digital products and cancellation rights
By downloading, accessing or purchasing any digital product from Etsy or Gumroad (including templates, planners, guides or other resources), you agree to these Terms.
In accordance with the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you acknowledge that your 14-day right to cancel does not apply once download or access begins.
By proceeding to download, you confirm you waive your right to cancel.
Digital products are non-refundable once downloaded or accessed.
If your payment is reversed, disputed or fails after delivery, you may lose access until payment is resolved. You remain liable for any outstanding amounts.
All digital products are licensed for personal or internal business use only. You may not copy, modify, redistribute, resell or claim ownership. All content remains the intellectual property of Hi This Is Bry.
10. Hourly coaching sessions
Coaching sessions are non-refundable once payment is received. By paying, you agree the service begins immediately and waive your statutory 14-day cooling-off right under the Consumer Contracts Regulations.
If you cannot attend your booked time, you may request to reschedule with at least 48 hours’ notice, subject to my discretion.
Results are not guaranteed. Advice is provided in good faith. Sessions are for the named client only and are non-transferable. Recording, copying or sharing any part of the session (audio, video or written materials) without written consent is not permitted.
11. Ownership, copyright and licensing
All original work created by me (branding, illustrations, layouts, written content) remains my intellectual property unless explicitly transferred in writing.
Clients are granted a commercial licence to use final deliverables for their business. This includes end-use rights but does not include source files or editable assets unless agreed.
Copyright ownership can be purchased separately through a written agreement and fee.
You may not resell or redistribute any fonts, assets or files included in final deliverables.
Final designs and digital products are licensed for use by the original purchaser only and may not be transferred or sublicensed.
Misuse, redistribution or false authorship claims may result in refusal of future service or legal action.
Hi This Is Bry retains moral rights after project handover under UK copyright law.
12. Fonts
Commercially licensed fonts are used, typically from Google Fonts or open-source libraries.
If you request a premium or custom font, you are responsible for obtaining the correct licence and providing proof of this if used for trademark or logo purposes.
I am not responsible for misuse of unlicensed fonts supplied or requested by the client.
13. Images and assets
I use royalty-free stock images (e.g. Unsplash, Pexels) free for commercial use. These are non-exclusive and may appear elsewhere. You are encouraged to replace them with your own photography over time.
14. Envato Elements (premium assets)
I hold a valid Envato Elements subscription. Assets from Envato (e.g. icons, textures) can be used in final client work but:

Cannot be reused, extracted or resold separately

Remain under Envato’s licence

Are valid only for that specific design
For exclusive ownership, you can request custom graphics or separate licensing at an additional cost.
15. Wix website ownership and responsibility
Wix is a third-party website builder. You (the client) must maintain your own Wix account and subscription. Wix retains ownership of the platform, templates and system components. These cannot be transferred by me.
I retain IP rights for all original design work created in the Wix project (layout styling, icons, illustrations). Upon full payment, you receive a licence to use these assets for your business.
This licence does not include:

The Wix template

Prebuilt Wix features or third-party elements

Fonts, images or integrations not created by me

You are responsible for compliance with all third-party licences used on your website.
16. GDPR and legal compliance
After handover, you are responsible for:

Acting as the legal data controller

Providing your own Privacy and Cookies Policies

Ensuring forms, newsletters and integrations are GDPR-compliant

Managing and securing any collected data
I am not liable for legal compliance after handover. Please seek professional advice if unsure.
17. Maintenance and support
Once the website is transferred, you are responsible for maintaining it.
I do not provide ongoing updates unless separately agreed.
You should log in regularly to manage performance, billing and security.
18. Canva-based designs
If your project includes Canva templates or assets:
You may use the final designs for your business (e.g. print, social media, web)
You do not own the Canva template, fonts or stock elements used. These are licensed under Canva’s terms
Editable links may be provided, but you must save them to your own Canva account.
You are responsible for having Canva Pro if required.
Editable files may be removed 30 days after delivery unless otherwise agreed.
I do not provide ongoing editing or support unless stated in your package.
19. Limitation of liability
To the fullest extent permitted by law, Hi This Is Bry accepts no liability for any loss, damage or harm resulting from use or misuse of services or products, whether direct or indirect.
This includes lost profits, missed opportunities, data loss or reputational harm.
All work is delivered in good faith, based on the best information at the time.
No guarantees are made regarding business results, sales or compliance.
You are responsible for ensuring your business follows relevant laws.
All strategy, templates and resources are for general information only and do not constitute legal, financial or medical advice.
20. External tools and third-party mentions
If a service or tool (e.g. Canva, Wix, MailerLite) is mentioned or used, this does not imply endorsement or affiliation.
I am not responsible for the behaviour, uptime or policies of any third-party platform.
I am also not responsible for issues such as downtime, platform bans or product removal by Gumroad or Etsy.
21. Availability and force majeure
I aim to provide stable services and timely communication but cannot guarantee 100% availability.
In the event of illness, emergency, power failure or internet disruption, I will notify you as soon as possible.
If I am unable to complete work, a partial refund may be offered based on the uncompleted scope.
I am not responsible for missed deadlines or service disruption caused by force majeure events such as natural disasters, technical failures or government action.
22. Governing law
These Terms are governed by the laws of England and Wales.
Any disputes will be handled under UK jurisdiction.
23. Changes to these Terms
These Terms and Conditions may be updated from time to time. The most recent version will always be available on my website.
